“The ban is unconstitutional, because the county has been unable to identify a constitutionally adequate justification for excluding plaintiffs from the institution of civil marriage,” Iowa’s Supreme Court Judge, Mark Cady, says in the 69-page opinion. “A new distinction based on sexual orientation would be difficult to square with the fundamental principles of equal protection embodied in our constitution.” he concludes.
Congratulations to all those for whom this marks the end of an arduous climb to a long-deserved victory.
Now, if those folk who gave the Iowa Courts such clearly wise counsel would care to work their wiles in the California courts, thousands of couples suppressed in this state could finally claim their true place in the land of the free.
